Share of land

(Querist) 03 February 2014 This query is : Resolved
Sirs,
My father in law has passed away a month back and my mother in law is now staying with her four sons in Gujrat. My father in law was purchased a land with his own source of income and built up a house 15 years ago. Now all the sons are asking forcibly their mother to share the land equally but she doesn't want.
Please advise me is she the sole owner of her husband property and she has right to sell to other person? What she can do to protect herself because she has a fear that after signing the property to their sons name, they will not care to her in future.

Regards
Udai

you have not mentioned whether your father in law left any will or not . if he did not leave any will on his death your mother in law and 4 sons shall have 1/5th share in property . apply for mutation of property in names of all legal heirs . she should under no circumstances sign any documents without prior consultation with lawyer

As per your query, she is your mother in law, if she is your real MIL, your wife being her daughter has also a share with others.

All legal heirs have share in the property.

Your MIL should avoid to relinquish her right in the property.
