Medical negligence- immediate help required

Hi,
My dad was admitted for PEG placement in one of the hospitals. After the surgery he had sudden cardiac arrest twice in the morning. The doctors were unable to diagnose the reason. My dad has hemophillia. But without discussing with us he was administered blood thinning injections as the doctors had suspected blood clots to be one of the reasons for the cardiac arrest. After that my dad started to bleed internally and they are not able to stop it. Blood thinning meds should not be given to hemophillic people its fatal. All the reports files etc are with these people as it is a private medical facility.
What are the sections under which I can file a case against them. And how do I make sure patient file is not tempered with. And how can I sieze it.
Can I lodge n FIR against them? Please help soon....

If nedical repprt suggest wrong treatment, you can indeed file case for damages out of medical negligence in consumer forum but for doing so you will be needing an exeprt opinion to support your case at the time of filing the case.

Yes, If there was wrong/defective or careless treatment,you can approach Consumer Forum against doctor/hospital and claim compensation towards the loss suffered by your father due tonegligent treatment and mental & physical agony but you have to porve that doctor has acted negligently/carelessly by expert evidence.

Whether the fact of suffering from hemophillia was disclosed to the doctors before or after the admission of the patient.
Have you discussed with some expert, whether some other treatment was suitable in such condition when suffering from hemophillia was not disclosed.
Some time calculated risk has to be taken in emergent treatment of a patient.
Please discuss with the medical expert and if confirm about medical negligence lodge complaint before consumer forum.

If what you stated is to be taken as a fact, you have a fair chance to file a case before the consumer forum for medical negligence and claim damages towards it, but before that please do consult an expert lawyer in this regard, proceed as per his advice.
