(Querist) 06 March 2014 This query is : Resolved
my 498a wife , is a government employ who has worked as part time tutor in an another government firm.is it legal to do two jobs at a time? what are the legal steps can be taken? is there any service rules for this in andhra pradesh.

A Tutor, while working as a Tutor cannot be an Advocate. But an Advocate, while being an Advocate can be a Tutor. Therefore, in the fact situation given by you, there is no illegality of any kind whatsoever.
Sudhir Kumar, Advocate (Expert) 07 March 2014
per-se it is not illegal to do two jobs unless service conditions of one of the job forbids so. Many persons (including domestic maids) do multiple part time jobs.

In this case the person is Govt employee and forbidden to do another job. But without proof you cannot expect his deptt to take action.

If you could prove such allegation, he will be in trouble. The govt. servant can not indulge in any other job or profession.
Try to take some pictures and gather ocular witness.
Then inform his superior.

INFORM WITH PROOF TO EMPLOYER/ GOVT.

In which capacity the person worked as tutor, as guest speaker / faculty or otherwise. Whether his service rules of main job permit such work ? You should raise the dispute and let the person face the situation with defense.

vindictiveness dosent pay .remember if he loses his job he wont be able to pay you maintenance . it is in your interest that he retains his govt job
T. Kalaiselvan, Advocate (Expert) 07 March 2014
In the name of wreaking vengeance on him, you stand to lose your entitlement of maintenance from him, so think wise before initiating any action in this regard. Ofcourse, a government employee is not supposed to take up an employment outside simultaneously.

in addition to what advised by lawyer above. I will add that if there is no divorce only separation and he continues a Govt servant you will be entitled to all the benefits if he dies.

Further peaceful settlements also take place after years of separation when couples like you realise their follies.
