Can a commercial tax officer under gujarat vat act, pass assessment order at its own, keeping aside the facts and figure of the case on the last day of the date for completion of assessment, without considering the facts and statements given by the party.

That is known as BEST JUDGEMENT assessment which can be resorted to only if the Assessee is not cooperating and avoiding to present his case/ documents to prove his returns, on dates fixed for hearing !
Aggrieved Assessee can not only apply for rectification BUT also appeal before the higher Appelate Authority, within prescibed time after service of the impugned Order
