I havent signed petition papers...

(Querist) 12 April 2014 This query is : Resolved 
I have engaged an lawyer from my city which is 700 kms from hyderabad Andhrapradesh high court

my lawyer said me that he has friends in high court practicing there, such that he asked me to apply for quash proceedings u/s 482 in 498A case.

My lawyer as he said he made me sign on vakalath papers. But not on petition papers.

Without my signature on petitioner documents and I also didnt attend the high court at the time of arguments, only lawyer whom got engaged in hyderabad had attended the case on behalf of me in 2012.

The court has disposed the case...


Now whats my question is....

I havent signed petition papers at all... i came to know that when i applied for certified copies.

Now can i refile the same case as a fresh petition in high court once again.

Please guide me

the petition needs to be signed by Petitioner . your lawyer could not have filed the petition without your signature . obtain clarifications from your lawyer .

Thank you Ajay Sethi ji, The Fact is when I applied to Certified copies in High Court, I havent found signature on my petition certified copies. Infact i wonder how superintends or clerks or judge how they accepted. Now the matter is clear sir, there was no signature on petition papers.

I will apply again as a fresh petitioner in high court.

It seems to be mistake of everyone out of plain oversight.

Your query has been addressed properly by experts, thus instead of flaring up the issue, better to remain silent if the orders are in your favor. Moreover, you have stated to have signed the vakalat hence you may not be able to prove your statements.
