Lawyers office in parking garage of tower

Dear Respected Sirs and Friends
I am a Company Secretary and Trademarks Attorney. I am a very junior person.
My father has a flat in a tower and in the same building we have a parking garage on ground floor, this is closed parking garage and we are in possession of this garage since last 13 years, now i want to start my Company Secretarial practise and open office in this parking garage, but society is not permitting the same, however we have managed to take a Shop Act License and an separate Electric Meter for the Garage. Also we have Allotment letter from builder that Garage is alloted to my father. My question is can I legally start my office from this premises. In the Municipal records the area is shown as closed parking area on ground floor, its inside the building structure. i am not making any alterations in the structure but i am just putting a shutter on the garage.
Please give your precious suggestions and advice on the same

garage is only for parking cars . you cannot use it as office .

well said by my learned friend Mr sethi ji,, But normal course in chennai some of the heart of city have practice to given that place for rent to such kind of office activity. so with the help of society only possible

but in the same building other people too are using their garages for different purposes, like they have made a temple inside 3 parking garages together, and then one person has made a room for his driver to sleep in the garage. so will there be any problem if i use it as office for practise, plus the Municipal Authorities too have given to me Shop Act License for the same.

you make application to society for permission . give instances wherein others have been using garage for other purposes .

Try to have amicable solution with the society quoting other examples in the building.

First of all, it is the prerogative of the society to allow use of the garrage for the purpose different than garrage.
Secondly, even if society allows you to convert your garrage in to an office that would be a misuse of the garrage in the eyes of the municipal corporation and law.
So, not as a matter of right, but as a facility, if the society allows you to use your garrage as office, you can use that as such till the time that does not come to the notice of the municipal corporation. Shop Act License or separate Electric Meter for the Garage is irrelevevant if there is no lawful usage of the garrage.

I think Mr. Dhingra has given a more convincing opinion and valuable suggestion to your query. It again depends on circumstantial adjustments and as properly advised it cannot be claimed as a right in the eyes of law, if you start a legal battle over the issue, you will stand losing it, hence a cordial approach will have its own answer.
