(Querist) 13 June 2014 This query is : Resolved
My wife has filed divorce on adultery and cruelty under section 13(1)(i)(ia) of Hindu marriage act 1955.
First notice received but second notice refused. I’m not appearing in court on date. what is the decision by judge.
Advocate M.Bhadra (Expert) 13 June 2014
The suit will be heard ex-parte and decreed.
Rajendra K Goyal (Expert) 13 June 2014
It would be decreed ex party.
V R SHROFF (Expert) 13 June 2014
Is it in collusion, that she file Divorce, and you will receive notice, but will intentionally not appear, for easy divorce??

In fact, you must file your Say against the Petition..
Devajyoti Barman (Expert) 13 June 2014
If you wish to contest the suit then appear in the suit and file tour written statement. Do not play with court.
Dr J C Vashista (Expert) 14 June 2014
If you have received first notice and you did not appear, that is enough to proceed ex-parte.
No second or subsequent notice will be there, it is your misconception.
Raj Kumar Makkad (Expert) 14 June 2014
You have raised very simple question which has also very simple reply-court shall proceed you ex-parte and shall go ahead ith the petition.
T. Kalaiselvan, Advocate (Expert) 15 June 2014
Agreed, you will be set exparte by the court and the judgment will be against your wishes.
