Flat attached with unpaid Income Tax Demand

Dear Sir,
As per the above subject,Flat is in jont name of my parents,first holder is my father & second is mother...my father expired in June 2004, Income tax raid case exists in name of my father, since 1998. Unpaid I.T demand is 2lacs. Flat is attached with this unpaid demand. Can i sale out my flat n pay the outstanding demand...?? Pls give your valuable advise for selling out this flat.....n...pay outstanding demand later.

You will not be able to sell the property unless the 'i.t. attachment' is first gets cleared. Or, if you get sufficient money as advance from the buyer, pay the i.t. demand with interest, penalty etc. (which will come to more than Rs. 2 lakhs after including interest and penalty), get the attachment removed and then sell.

Otherwise it is not possible.

Even after vacating attachment consent of your mother, if alive, is essential.
