can you file a complaint through facilitation council of msmed, for payment that has not been recieved for services rendered bfre geting registered with msmed act 2006.

so we have our small firm that did business with a few firms (A & B) in nov2013.
our firm then went on to getting our final registration as an MSME in January 2014
since then firms A and B have not paid us yet and are refusing payments with silly excuses,
Thus we decided to file complaints with the MSME facilitation council
they have accepted our complaint but they claim that the additional district commisioner may not allow the case to proceed for the foll reason:
they say that since the business was conducted by our firm with the said firms A & B before we got our Entrepreneur's Memorandum (EM), they may not be able to help us in this regard, thus they are going to present the file to the Addl Dist Commisioner and let him advice
we request your help to show some precedence in any previous case which then makes the commisioner accept our complaint and is bound to help us out

The Council is correct in its approach. This council is not authorized to deal with the transactions executed before the registration. Let the council obtain proper guidelines from the proper authority.

Dear friends,
My client is a small enterpreneur as per definition of MSME act.He has provided an erection & installation service to a public ltd company (Big company)in the financial year 2011-2012......The company has paid only less than 10% of the total due......
Can i register my client under MSME act 2006 and file a suit against the company for recovery of my clients debt......

You can definitely do as desired as your status is not dependent over the given transaction.

Registration for small enterprises is not mandatory for a small enterprise.
For non payment of dues, as per MSME Act you can refer the issue to Micro and Small Enterprises Facilitation Council.For more details pl. refer to the Act and Notifications made thereon.

Hi,
I may differ a bit. The Act is ambiguous about the above stated query. Hence i would opine that one should try his luck before the council and should approach the higher forum in case it is not successful.
