Marrigae consumate

(Querist) 27 July 2014 This query is : Resolved
I have filed the case for nullity of marriage as my marriage was not consummated. This fact that marriage was not consummated has accepted in the family court.

Is it mandatory for me to give compensation to wife even the marriage is not consummated?
ajay sethi (Expert) 27 July 2014
yes wife can claim maintenance even if marriage is not consummated
Devajyoti Barman (Expert) 27 July 2014
Yes, if your wife is not earning lady then you have to give her alimony at the time of decree of nullity at the discretion of the court.
K.K.Ganguly (Expert) 28 July 2014
1. Non-consumation of marriage is no ground for nrefusing to pay alimony or maintenance,

2. She can file a petition u/s125 of Cr.P.C. claiming maintenace from you, if she is not employed, in which case you shall have to pay her the said maintenance, amount of which will be decided by the Court.
T. Kalaiselvan, Advocate (Expert) 29 July 2014
Nullity of marriage has got nothing to do with the maintenance claim. She is very much eligible as per the provisions of law to claim under this circumstances too.
