Builder not getting the work done

Hi..
I am a resident of Andheri west. I have been staying the flat for the last 4 years.The builder however , has not been getting the pending work completed over the last 10 years(age of construction)..The builder keeps giving assurances whenever he meets that the OC is going to come and 24 hrs water facility will be provided however the same is not being done so far.I have a 2 year old son and also senior citizens , I would request if i can get an advice on how should i proceed with the matter ..can i file a case in the court? if yes, then what all rights do i have in such situations that i can file the case.

You can file a case in the consumer forum wherefrom you get the necessary reliefs. Act fast.

Are you alone, or there are other flat owners?
What is the view of the other flat owners?
Do they also want to take action against the builder?

I agree with expert Mr. Devajyoti Barman. Please reply the relevant questions raised by expert Mr. Anirudh for proper evaluation and analysis of the case and give opinion.

Consumer forum will take a lot of time for the matter to get resolved ..is there any other faster way?Should we go for MOFA?
Most of the flat owners are investors and not staying in the building..There are in all 164 flats of which 100 are commercial premises and the remaining are residents..Very few owners are staying in the premises.

Consumer forum is the fastest option and your apprehension for delay in proceeding before this forum is clearly misdirected.
To go to consumer forum you do not need any other flat owner to sail in the same boat.

consumer forum takes 2 years to dispose of complaint . builder is bound to obtain OC . move consumer forum against builder and seek directions to builder in this regard . also seek compensation

As advised by expert you can approach consumer forum for relief, but if you have any other idea than this, you can proceed without consulting anyone here or anywhere.
