Restriction for leasing flates to bachelors in apartment

(Querist) 03 November 2014 This query is : Resolved
Dear Sir,

I am residing in an apartment with 30 flats. this Building is located near a Engineering college, so many flats in the building has been given to students on rent. Because of this the families are facing problems like for example loud noise during night or late night parties. The society is not yet formed. And majority of flat owners have given flats to students, so can we take any action or ask legally the owners to restrict on leasing their flats to bachelors or student?

Request you to please give your expert comment on this.

there is no society formed till date . once society is formed it can lay down rules and regulations for lease of flats by members . however society cannot frame any rules contrary to its bye laws

Thanks for your reply,
But the society will lay rules as per the majority, and majority of owners have rented their flats to students.

If at all you are facing major problems because of any tenent/student you could initiate Legal Action against them even as an individual.Consult a Local,Good Advocate.

Mr. Narasimha,

Thanks, In my case, there are 30 flats in my building, out of I think 9-12 flats are vacant, in remaining flats 4-5 families and rest are rented to students.
So if you see the residing families are few then the rented flats. Can we force the society to restrict on renting flats to students or bachelors?

Society would take a view after formation. If aggrieved from any particular student, lodge complaint to police. For late parties / disturbance police can be informed.
