Loss of document

sir,
from an expert advice,
i like to now few point,

1. can anyone file a complaint in police station about loss of property document (title deed)and can get not traceable certificate after a period and publish in news paper.
if yes, then land graber use this method and registar a document easily.

then what is the safe guards given in the law for the orginal land owner.

Police complaint is not mandatory to get certified copy. However it is prudent to do so.
But this method has nothing to do with registration.

Only the Actual Owners would be Eligible to File a Police Complaint and Obtain FIR.After FIR a News Paper Advt has to be Published regarding Missing.Then a Case to be Filed in Court Regarding Missing and the Court after Issuing Notices to Registrar Would Endorse the Copy of Documents which would be Treated as Original From Then.This Is the Procedure For Missing Documents.Copy of Documents could be Obtained by any one .Consult a Local Good Advocate.Any Illegal attempts by any one would be Crime.

While I agree with the procedural aspects narrated by expert Shri Rajkumar, I could not understand how a land grabber use this method and register a document? When the original document is with the original owner, if anybody obtained such certificate will not have any value in law. What exactly your problem?

It is a misconception that title is a question of document, it is rather a question of fact.

sir,
i agree with Mr.N.J.S.Rajkumar alias narasimha reply, but the question is if a person goes to police station says that i have lost the property document in this area, so the police have no means to confirm the ownership at that time, i like to know from experts, what is the duty of police officer when a person comes and gives a complaint like this and what action he has to take as per the law.Is it mandatory to file FIR or not.if yes, FIR is a publice document or not as RTI act.

police doesn't register fir. he is mentioning the information provided by you in his general diary.

there is no duty of police officer to search your original document.

information lodged before the police by you, only safeguard you against any missse by anyone.

lets a case
1. "a" sells a property to "b" and its regd in sro
2. after 10 years " a" files a police complaint that his property is lost
3. all revenue documents are in the name of "b"

once property has already been sold By A to B then A cannot file police complaint that document is lost . if A issues public notice B will come forward and mention that property has already been sold by A to B .

After lodging FIR and publication you will have to file a suit for declaration and permanent and mandatory injunction impleading all parties including Sub Registrar through a local lawyer, when your version is presumed to be true and correct.

In the mean time I have filled a rti application to the police, I got a reply from saying that it is 3rd party information, I have filled a first appeal, the information I have is
1. Copy of complaint
2. Copy of the proof of ownership
3. If no to information 2, I/O of the case with knowledge and wisdom ensured or not.
pls advice me what to do

If the property was sold 10 years ago but the vendor is creating nuisance by lodging a false complaint of missing documents and obtains anon traceable certificate and the vendor again obtains the certified copy of the sale deed document, then what about the subsequent sale made 10 years ago in favor of b? Though you may not divulge the proper particulars of the people or case in question, you may furnish more details in order to have a better opinion from the experts here.
