(Querist) 06 December 2014 This query is : Resolved
The property is in Joint name of my father and mother at the time of purchase. Father passed away and obtained required death certificate , family membership certificate. The amount for the property purchase given by me. Hence no objection from only one sister & my mother. Mother is with me.

Now, how to transfer the property to my name. What is the procedure. Pls suggest.

it is immaterial that you had paid money.
(also it is benami transaction, if you have directly paid to the seller).

to transfer in your name, your sister and your mother have to execute gift deed in your favour.

Your sister and mother have to execute gift / relinquishment deed in your favor.

on your father death his share in property would devolve on your mother , you and your sister . your mother and sister can execute gift deed in your favour to transfer your father share in your name
T. Kalaiselvan, Advocate (Expert) 08 December 2014
As advised by experts, you may ask your mother and sister to execute a registered release deed relinquishing their rights and interests out of their respective shares in your father's share out of the joint property in your favor and your mother may gift her other half share of the joint property in your favor, which will make you an absolute owner of the entire property enabling you to mutate the revenue records also on your name accordingly.

Well advised by expert Shri Kalaiselvan. No room to add any more.
