Regarding will

(Querist) 05 January 2015 This query is : Resolved
Dear Experts,

This is my general clarifications. WILL is not registered which was prepared in year 1994, that WILL can be accepted by Govt register office to do any sale transaction or any bank has authority to provide loan on that WILL ? what is the procedure to make WILL as register?
Dr J C Vashista (Expert) 05 January 2015
Incomplete information, vague and academic query.
Is the testator of the Will alive?
Show the document of Will to a local lawyer, seek his/her professional advise and guidance.
Devajyoti Barman (Expert) 05 January 2015
Yes.
Will can not be registered anymore of the testator is not alive anymore.
Rajendra K Goyal (Expert) 05 January 2015
Loan can be taken on the property bequeathed under the will and not on the will itself.

will can be registered even after death of the testator .
benficiary under the will have to produce will, records relating to the death of the testator, witness and the scribe before the Sub Registrar. If Sub Registrar is satisfied about the truth and genuineness of the execution of the will, he will register.

affidavit has to be made by witnesses that will was executed by testator in our presence , that he was of sound mind , that testator signed the wil l after reading the contents in our presence
