Cooperative housing society/

(Querist) 07 January 2015 This query is : Resolved
In a cooperative hsg society in Navi Mumbai, when a owner gives his flat on rent
1. the society is charging 110% of as the monthly service charges.
2, The society under its right to raise funds as per the bye laws is asking for a donation fee over and above the additional 10% service charges.
My query is can the society ask for donation for letting out the flat on rent? If yes what is the amount they can demand.
Kindly enlighten.

advised to pay what co-op soc ask.
It is used for u all only.
live in co-operation and peace.

struggle can be costly, u need to register LL agr with payment of stamp duty regn. , wait for managing committee to approve, get police clearance, with all details of all who want to reside.
all earning taxable !!, Think over.. give & take or fight??

You can refuse if any money asked against the bye laws / resolutions. If the fee / donation demanded is not much, may be paid as legal path may be cost and time consuming.

Sir,
[1] The society has a legal right to charge extra 10% of the maintenace amount, if the flat is given on rent.
[2] The society can not demand or charge anything extra for permission to give the flat on rent, under any pretext whatsoever.
You can approach the Regsitrar of your area if you want to complain about the illegal demands/charges of the society.
Good Luck,

The charges seem to be illegal. The society is taking advantage on the tenants, you may refuse to pay.

Dear Sirs,
Thank you all for very prompt and valuable advise.
The society is however adamant on its stand that the donation needs to be paid, citing reason that the same is as decided in the AGM of the society.
Kindly enlighten.
