Want to get out of guarantor

Sir,

I had given court guaranty for 1 of my friend in the year 2008. He was been charged sec.419 and now he is not in touch with me.

Court had issued me a showcause notice as accused is not traceable and I had given the guaranty of Rs.15000/-

My relation with said accused is strained and we are not in touch. I have details of his family members.

Kindly advice how to go about on this matter.

Move an application to the court for discharge from surety.

Yes but court may not discharge you and ask you to pay the penal amount until the person is caught.

No escape, you can't get out of it now, except by producing the accused before the court or to deposit guaranty amount, if not already paid.

I agree with Mr.PS Dhingra, Magistrate had made to pay/deposit guaranty of Rs.7000/-.
