Reg : builder not paying maintenance charges for non sold flats

Hello,
Our society is not yet registered, but we are paying maintenace to builder from past 4-5 years. Now builder is going to form a society but he said he will not pay any maintenance charges for non occupied flats. there are still 12-15 flats yet to sale.
My questions :
1. Shuold we ask builder to pay the maintance for non sold flats? ( he is already declined to make the payments)
2. Is there in law for that?
3. If yes what is the law?
4. There is many maintance work going on in society but builder is not paying any charges for that, he is saying you have to take care of it. He is showing negative balance for society funds.
What is the law or act section for same to recover the maintenance charges.

get society regd first . settle accounts with builder . then raise maintenance bills for un sold flats . if builder refuses drga him to consumer court

Get the society registered first and get the accounts settled with him. After raise the maintenance bill and recover the defaulted amount legally.

So we can ask the maintenance which is due before registration of society? E.g. can we ask maintenance for last 4 years? He is now agree to pay just water charges. Not other manitenance.
