Hon'ble Sir.
One party came to me to make declaration of title by suit regarding to the SERVICE INAM LAND, 50 acres, in Tirupati, settled and conferred on their ancestors in the years of 1958. Since then their ancestors have not alienated or transfered the land to any person. But defendant has been possessing and enjoying the Service Inam Land since very long back by having Title Deed and Pass Book. Sir, My doubt is, today My client can get the Title back from the defendant under any statutes. Please advise. Thanking You, Sir.

As per words, plz read this "But defendant has been possessing and enjoying the Service Inam Land since very long back by having Title Deed and Pass Book.
So how you could get back the said lands in your client's favour. It is not possible.

What were the conditions in which the Service Inam was granted? The year could not be 1958 as post-Independence public policy has been one of abolishing such alienated tenures.

As per Post-Independence public policy my client got Patta after Surveyed and Settlement by Inam Commissioner.

My ancestors are also possessing such Lands in Vizag dt. AP. My father tried for a long time and died.Me and brothers are legal heirs of these lands.
I also approached Bhoodan society nothing happened.
I will be happy to know the present progress of Inam Lands.

If you have related papers showing the title backing the original owner, you may file a declaration suit but what about possession?, In whose possession and enjoyment is the property now and since how long so that the clause of adverse title is not attracted.

Thanks for your concern.
I have still refer the old documents available with my old mother etc.May be more than 50 years old . My dad did wrote letters to Revenuye authorities and Tahsildar acknoweldged it.We have original old very old stamp papers evidencing gift of lands to our family members by the then Rajah of Vizianagaram.
Anyway I know and remember that the property is identifiable and possession is wrong Govt. allotment to backward classes etc. some portion of the land is vacant and the politicians there played false deeds.
If i have a colelague deals with Inams in AP I shall be happy to coordinate.

Inam is an alinated tenure in the sense that the Inam holder is conferred with revenue rights. It could be of two types - the land in the occupation of the holder, withou paying any land revenue to the Government/Sovereign and the land in occupation of other persons where the holder is entitled to receive land revenue.
The public policy, post independence, has been to do away with the alienated and such tenures have been abolished in almost all the states by law. The general scheme of these laws has been allow the actual occupant/ cultivator under ordinary survey tenure; thus inam holder continues to be occupant of the lands in occupation but for other lands, the actual cultivator gets the absolute title. The authority in carrying out this task is vested with the respective settlement commissioner.
