I am working as Junior Hindi translator in Defence Estates Dept., Ministry of Defence in PB-2: 9300-34800 with GP 4200. I have joined this post from 04th Feb 2015
I have been selected as Tax Assistant in Income Tax Dept. in PB-1: 5200-20200 with GP 2400. I want to join this post because of better promotional chances which is nil in Def Est as JHT.
I want to know how can I apply for Technical resignation once I get Appointment Letter from Income Tax Dept. using pay protection benefits.
Plz advise……..

When did you apply for the new post and whether through proper channels?

Sir,
I had applied for the SSC CGL 2013 Exam (in which I have been selected as Tax Assistant in Income Tax) before joining my present job.
Even I have given its interview on 30th Jan 2015 and joined this office on 04th Feb 2015.
But I have informed my present employer through letter after joining here.

Forget about technical resignation.
dineshchandrayadav (Querist) 11 May 2015
Sir,
Is it not possible in my case?
Can you plz tell me the reason?

If I cannot avail Technical resignation benefits then in which manner should I resign?
Guest (Expert) 11 May 2015
Simple resignation letter. Even if you submit in the name of technical resignation that would not be acceptable as such or would be taken as ordinary resignation, as you do not fulfill even a single condition of a technical resignation.
dineshchandrayadav (Querist) 13 May 2015
Sir,
If you don't mind plz tell me what are the required conditions for technical resignation?
I am totally new in Central Government job and it is my first job.
Plz give the details so I can get some idea about technical resignation.....

Mr. Dinesh Chandra Yadav,

You have already been informed that you are not eligible for technical resignation. You should not expect me to hold tutorials for you to chart out conditions for technical resignation. For conditions, either you ask the person, who has told you about the technical resignation, or go through the Rules, regulations and the Government of India decisions regulating your service in the Central Government. Even then, if you get any doubt in your understanding about any specific condition only then ask for clarification.

Sorry sir to trouble you, I have read Swamy's handbook but did not get satisfactory information thats why I asked here.
Plz guide me in which book I can get these details or any website address where I can get informations.
Thanks in advance.
Guest (Expert) 13 May 2015
Would you have read carefully, Swamy's Handbook is quite clear about the terms.

Question arises, does your department know that you had applied earlier for the SSC CGL 2013 Exam and if so, how the event came to its knowledge?
dineshchandrayadav (Querist) 13 May 2015
Yes I have informed my department that I have applied for SSC CGL 2013 through letter.
Before joining this dept. on 04th Feb I have given CGL 2013's interview which was on 17th Jan.
I have written a letter regarding it and enclosed my CGL 2013 interview admit card also for my dept. information.
Guest (Expert) 13 May 2015
On which date did you inform?
dineshchandrayadav (Querist) 13 May 2015
I think in mid April, because I was totally unaware of tech resignation. Neither I would have informed them in February itself.
Guest (Expert) 13 May 2015
That is why I have told you to forget.

However, you could better have tried your luck in your department by sending your technical resignation rather than asking your question here. But even if the department accepts your resignation, as technical resignation, you won't get any benefit.

Now don't ask, why you won't get any benefit, as I don't prefer to solve your academic exercise. For that you will have to go through the pay fixation rules applicable to your department.
dineshchandrayadav (Querist) 13 May 2015
anyway Sir, thanks for your help.
I have still not got Appointment Letter from Income Tax Dept., after getting App. letter from them I will put my technical resignation in my present Dept. (Defence).
Guest (Expert) 13 May 2015
Best of luck.
dineshchandrayadav (Querist) 13 May 2015
Thanks sir for your suggestion,
lets c what happens
