Dear Sir,
I am working in a mfg company, my joining date 22/03/2011 but now my company planed to terminating me due to cost cutting i have not received any notice this regard, so i want to know about eligibility of gratuity, which time period required to claim gratuity.

Although quite a premature query without any cause of action, yet having less than 5 years of service, you are not eligible for gratuity.

How do you know that you are likely to be terminated and company is contemplating to make your position/you redundant and terminate?
There are many ways for cost cutting e.g. reducing the perks of executives etc.........
Are you a member of employee's/trade unions?
Is gratuity mentioned in your CTC?

Your counsel may opine and help to build favorable written record and can opine whether you can stake a claim to retrenchment compensation!
You should also firm up our next venture and keep an offer in hand.

i don't have an appointment letter and salary structure. Still not received any notice letter, but accounts manager told me verbally director planing to terminate current staff.
and i am not a member of trade union.

Do you have any document pertaining to employer-employee relationship since 22/03/2011...................atleast say.........an I.Card, Salary Slip, credit of salary in salary a/c in bank, name in Muster, PF a/c,ESIC Card, Form16 etc?
