Parking at apartment

(Querist) 17 March 2016 This query is : Resolved
I live in an apartment( ownership) whose association is not registered. I have a car and dont have a parking place.I usually park it in a free space. Now the association is pressuring me to pay monthly charges of Rs 3000 for a four wheeler parking. Can I protest saying, it is the common space and I have already paid for it.

Pressurising! Have they demanded in writing?
Rajendra K Goyal (Expert) 18 March 2016
If they have asked in writing, move to registrar of societies / police against extracting money in unauthorized way as society is unregistered.
Dr J C Vashista (Expert) 19 March 2016
Association (unregistered) is non-est and has no authority to claim, did they ask? If so, file a suit for declaration and injunction through a local lawyer.

Common space/area cannot be used for personal benefit/usage like parking of your car.

Consult a local prudent lawyer.
