Roof right on DDA flats

Sir, whether top floor owner is having roof right to construct room and use. Whether another GF and Second floor owner is having roof right of top floor. Whether it is common for all .

In absence to any specific clause all the flat owners have equal undivided common right over roof and the top floor owner in absence of specific valid contract with the builder can not have any exclusive right over the roof.

If the conveyance deed from DDA is silent in the matter it is common space for all the owners of the building.
