Property purchase disputes

(Querist) 19 April 2016 This query is : Resolved
I have purchased one plot in 2014. I have completed all legal formalities related to purchase including registration and 7/12 and pher phaar entry etc. Property having clear title on single name. But now old land owners wife is claiming her right on property due to their divorce case. Is their any legal risk to my property?

Did you verify the previous document i.e.the property of the document of your vendor? is he the only having the title? come with full details for proper reply.
S Raut (Forensic Expert : IFS) (Querist) 19 April 2016
Yes. He is only owner of said property since last 7 years. I have advocates search report which states that it is self acquired property, owner of property is an undisturbed actual possession of the property and title is clear.

The clear authority of the seller at the time of execution of the final conveyance is to be seen. If it is clear then no need to worry. merely the divorce doesn't amount the litigation over the property which has been disposed earlier.

Okay Sir. Thank you so much. Yes there is clear authority of seller.

If the previous owner was having clear title, no stay from court nothing to worry. Defend the case through your lawyer.

A divorced woman can have right in the property; but the children of that relation are the legal heirs to their father.
S Raut (Forensic Expert : IFS) (Querist) 21 April 2016
Ok. Thank u.
Can you please give me any such example case details / judgement for reference?
P. Venu (Expert) 23 April 2016
In reply above, the first line may be read as "A divorced woman can have no right in the property" instead of "A divorced woman can have right in the property"

The lapse is regretted.
