Dear Sir,
Need your valuable advice. My wife has filed a false 498a, 323, 406, 506 2 years back and case is pending in Gurgaon court. Last month she had filed a domestic violence and section 9 in Delhi court.
I am not able to understand their trap.. What she wants? Can you please suggest me what they are trying to do?
Moreover My lawyer is pressurising me to file for divorce at this stage as once we win all these cases we will not have any grounds for divorce. That's what he said..as far as my understanding is concerned. If second party is not ready for the divroce then filing for divorce will be a waste of time, energy and money. And the kind of inlaws I have I don't think they will leave me without having a hefty amount of money.
Can u please suggest should I file for divorce at this stage? As already two cases in different states are pending on me and it is so painful for me to run like a pendulum in both the States. Please suggest what to do? Should I file for divorce? And dv can not be filed if 498a is pending...please suggest me on that also.

Meet the issues on merits. If the decisions are in your favour, false accusations themselves would be a cause for seeking divorce.

Dear Neeraj
There is two option, either be defensive or be in the mood of attack.
fight the case with the help of lawyer on merit and try to prove her cases as false and fabricated and win the case, when you win the case then you may get divorce very easy based on cruelty.
at present there is no need for any divorce case, remain you know better your situation.

be clear that the criminal liability doe snot extinguish if divorce is granted. Both the cases will still have to be faced.
So far you have not stated what ground you have to seek divorce.

You must have faith in the advise and proceeding of your lawyer since s/he is better equipped with the circumstances, information of your case(s) and the counsel of opposite party.
Being a male you do not have the option except to be defensive since Indian laws are heavily tilting towards female, which are generally misused.

Respected Sir... my only point over here is my case u/s 498 A, 323, 406, 506 is under trial from past 2 years in gurgaon court and recently my wife has filed for DV in Delhi court...my ques. Over here is
Ques. Can two different cases run parallel against me like this wherein one case is pending and she has filed another in another state? Is it as per law?
Ques. My 2 years got wasted in this case already and I don't want to ruin my career and life anymore. Please tell me when should I file for divorce sothat getting a divorce would be easy and quick for me. Should I wait till the time my Gurgaon court passes a judgement in my case Or should i file for divorce now sothat both the cases I.e. divorce and 498, 323, 406, 506 finishes almost together.
Please advice Sir....it really means a lot for me....
