Consumer act complainant

(Querist) 06 August 2016 This query is : Resolved 
We paid rs. 5 Lacs to a private property dealer for purchase of a plot. Later he could not arrange the specified plot and returned rs. 1 lac, balance 4 lacs, he did not return so we filed fir against him u/s 406. Now can we also file case against him under consumer act for recovery of money and compensation.

Yes,you can file complaint before Consumer Forum for dealers deficiency in services.Both consumer and criminal action can be taken parallel.No bar.

U can't file consumer complaint against him but can file recovery suit in civil court.

From the facts stated it appears that the person you had engaged was an agent than a seller.

From your act you can not come under the definition of consumer. Hence no consumer case can be filed.
But you can file complaint before criminal action can be taken for fraud.

Consumer forum will not entertain your complaint since you are "not" a consumer.

File suit for recovery through a local lawyer.
