Cheque dishonor

Respected sir/mam,
I gave an amount of rupees 50000 on behalf of a postdated cheque nw he is not returning the money. So wat should i do to get tat money. Plz i request to give some suggestions the only proof i have is ma bank. Statement and the cheque

yes u can intiate cheque bouncing prosecution. you dont need to prove about debt. its presumption that defaulter was liable so he has issued cheque. proceed. but mind that prosecution is technical so consult local lawyer or me.

Or if all efforts have failed, present the cheque.

Issue legal demand notice followed by complaint before jurisdictional magistrate within prescribed period in terms of Section 138/142 of the Negotiable Instruments Act, 1881.

Whether the post dated cheque was presented and bounced. If so when?

Notice of dishonor has to be issued in time . Discuss with local lawyer and send notice if time left.

If time exhausted, file recovery case to recover the amount.
