Redevelopment and disqualification under m2o bond

(Querist) 10 July 2017 This query is : Resolved
I bought flat in redeveloped building in 2013, which got OC, and i got possession in May 2014. Old society as it is will continue and their MC members. Society MC term was expired in Jan 2016 still continuing without election or new committee. old building had 13 members and new flat purchasers to be added as members are 12. out of the 13 old members couple of members approached registrar office with complaint of redevelopment and financial irregularities. final hearing was happened and order to be passed as the Society Management committee which was taken control of the society in feb 2011 was not signed the m20 bond. committee disqualification order will be passed very soon. now my question is what will happen to redevelopment which was signed in June 2012? what will effect to us as new flat purchasers. will that mean our property purchase becomes null and void being redevelopement agreement is becoming illegal due to disqualification of management committee of the society?. what action can we take against builder and society committee as few old members will support us for filing the case? kindly suggest

The facts, as posted, are confusing.

Dear Sir fact is The Management committee which was elected in feb 2011 didnot sign m20 bond. the committee then took one builder for redevelopment and done area & financial irregularities since 2011 to 2016. When couple of old members came to know about the fact of irregularities, made complaint with registrar in 2016. Last hearing of the complaint happened and committee failed to produce the signed m20 bond. Registrar is going to pass the order of committee disqualification since feb 2011. now redeveloped building got oc in 2014 and also new flat purchasers also occupying the flats.
what sill happen to redevelopment agreement which was signed by the same committee which did not sign the m20 bond?
will this effect the new flat purchaser?
will the redevelopment agreement becomes null and void on the ground of disqualification of the committee?
what action can be taken against committee and builder?
kindly suggest

I presume you are new flat purchaser in redevelopment of the project.

1) According to me you are consumer and they have sold you flat
2) Since you are consumer there are various remedies available and you are in possession of flat too so you are safe.
3) According to me you will be safe and protected / guarded eventually but which kind of dispute and which orders are passed will determine the course of various legal proceedings.

4) See at this stage it will be imaginary situation what can take place , it is like thinking what is probability of you meeting with accident while travelling ?

I will reply for this question it is your anxiety their are various legal remedies in favor of consumer and you will be eventually be safeguarded . Have faith and keep watch which orders are passed and get certified copy and within 7 days take next opinion . Please note 30 days are generally appeal period from date of order.

5) If you are any other person apart from flat purchaser I will state please determine what you want then only proper thing can be told
