Summon not received

Querist : Anonymous (Querist) 04 October 2017 This query is : Resolved
My husband was torchering me to give divorce. For that he has filed a petition in family court. Till this date I have not received any summons. Voluntarily neglecting all those summons. My child born on April 11 this year, he has not even saw my baby. I don't know what is the reason.today is the last day for divorce. I didnt go and i cant see him aswel. sure I think judge provide him divorce. Will they?? Or they will Cal me one more time???
Ms.Usha Kapoor (Expert) 04 October 2017
if YOU AVOID COURT SUMMONS AND AVOID COURT HEARINGS YOUR HUSBAND'S TESTIMONY WILL BE RECORDED AGAINST YOU AND HE WILL BE AWARDED EX PARTE DIVORCE.ON THE FINAL HEARING DAY YOU MAKE AN APPEARANCE AND PRAY THE FAMILY COURT FOR TIME TO FILE YOUR COUNTER AND GIVE TIME TO HEAR YOUR SIDE OF THE STORY ALSO. DON'T FORGO THE OPPORTUNITY.
Vijay Raj Mahajan (Expert) 04 October 2017
The Family Court may order for newspaper publication of court notice as substitute serving of notice to you on the application of your husband u/o 5 r 20 CPC. If after the publication of newspaper notice still you fail to appear and defend the divorce petition the court will proceed ex-parte against you and record the evidence of your husband before granting him divorce.
By not appearing in the court you are giving free hand to your husband to move ahead for dissolution of marriage without paying any compensation to you and for your minor child.
You must engage a lawyer and defend the divorce case that may not otherwise be easy for your husband to get.

No advice from me to an author who is anonymous.

You can post the query in fresh thread with your identity and material facts.

Court may grant ex-party divorce on the basis of petition. You have right to oppose the petition and claim maintenance for your self and for your baby. Dont sleep over your rights. Appoint advocate and fight out the case. You can also take help of free legal aid service (but they are fresh lawyers) so please take care while appointing advocate.

See the fun, a fake ID person, Mr. Kumar Doab (unreal name) asks the querist to posrt with his ID. The querist may or may not get replies without ID, he should have advised him, if he knew the solution to the problem, which I am sure, he does not have any..
Guest (Expert) 04 October 2017
The anonymous querist witll be justified, if he asks Mr. Kumar Doab, whether he is really a legal expert, with what legal qualifications and also whether he also is appearing with his real ID or not.

Better to ignore the Query than insulting them

Demanding money from the innocent querist to be avoided

Demanding money from the innocent querist to be avoided applicable to the person who had done it openly
Rajendra K Goyal (Expert) 05 October 2017
Expert,

Seems you do not know what is insult. Refer dictionary or ask from some other fellow..

it would be better for the forum / author to contribute and share your knowledge if you can / have, rather to comment only for comments.

Guest (Expert) 05 October 2017
@Rajendra K Goyal.

Where is the question of arguments by you? If you have made purely a vague reply without any advice, Mr. N.J.S. Rajkumar can also be expected to post his comment.

By the way, when you decided not to advice, what was the relevance and purpose of making a meaningless post on your part, as the querist did not specifically ask your advice?
Guest (Expert) 05 October 2017
@ Rajendra K Goyal,

So far as your point about posing master of the forum/ club/ knowledge/ intelligence, fact, not only me, but every reader would have observed that only you and your close associate, Mr. Kumar Doab have been working in such a fashion to dominate over the LCI, the other experts and the querists, as if the LCI is the personal estate/ domain of the you two feudal lords.

In fact, due to multiples of vague and irrelevant posts of both of you, many real experts would have tried to respond to the problems of the querists to avoid any misunderstanding about them in the minds of the querists.

Question arises, when both of you don't know even ABC of most of the topics, why you people venture to make vague, irrelevant and meaningless posts against every query. If you think mere adding irrelevant posts after posts is the yardstick of your recognition as an expert, you may be living only in world of fools. Better demonstrate your real expertise in giving realistic and practicable advice, if you actually know something. Otherwise, you are gradually losing your own credibility day after day due to such vague and irrelevant posts.

Mr. Jigyasu,

Your observation is quite perfect.. I also avoid to post my opinion, when Mr. Kumar Doab, a fake expert and close associate of Mr. Rajendra K Goyal statrts making totally misleading and wrong advice for the querists even without understanding the basic question. Not only that out of his irritation and frustration he starts making abusive posts, when pointed out to review his wrong advice on legal aspect. He makes plenty of abusive posts in continuation just to sidetrack the issues.

I really appreciate your analytical expertise.
