What do u mean by counter affidavit when a person can file counter affidavit 7 what are the benefit that a party earns.

When it is complusory in which proceedings ?

Counter affidavit means counter to the petition by way of affidavit and it is required to be filed by respondent/defendant in each and every case/petition as and when demanded by court.

benefit of filing the counter affidavit is that the version of the party filing it reaches in writing before the court and it helps in deciding the issues before it and further legal proceeding follows thereafter.

Counter means 'to counter' the pleadings of the other party, i.e. to place your side of the pleadings against the other party !
