Querist : Anonymous (Querist) 28 June 2010 This query is : Resolved
What happens in this situation?

1) Lower court trial on 498a by defacto complainant
2) Quash proceedings in HC by opponent

Will both parties will go to HC
OR
Will both cases will individually run until judgement?

Dear Anonymous,

The High Court will first consider the matter on merits and then if it may deem fit and proper may (pass some interim order or staying the proceeding, calling for the records of the case, seeking reply from other effected parties or may reject the petition) appropriate order/s, Directions.

Best Regards

Daksh
