If accused rapes dead woman, then what kind of punishment is prescribed by law.

It is not an offence of rape at all. The culprit has to be admitted to some mental hospital for treatment of necrophilia.

It would be a 377 offence - unnatural offence, not technically a rape as per 376.. I agree with Mr. Subramanian on the second part - the accused should be hospitalized in a mental institution.

The unnatural offence also has to be performed on a live human being or a live animal to constitute an offence under Sec.377 I.P.C.
