(Querist) 31 August 2010 This query is : Resolved 
an acer notebook was purchased in 2009 august but due ti inherent fault in it, it was replaced but the new notebook also had same fault. after 7 months the notebook was replaced with another model but its seal was broken.THis notebook was taken under protest and was sought to be returned but the acer office refused to take it back...now the purchaser has gone for litigation in consumer forum for recovery of money paid plus compensation.....the complinant has both the notebooks owing to refusal on part of company to take back the notebook..............meanwhile the company has threatned the complinant with asuit for recovery of the first notebook...is this suit for recovery by the company maintainable????

No it is not maintainable. The co. at best apply for set off in your suit.
