When can I made employer the party by name

Querist : Anonymous (Querist) 26 November 2010 This query is : Resolved
Sir,
I was working in Govt sector and last month the Chief Executive Officer(Administrative In charge) has terminated my services without notice
I want to sue the organization and want to made him party by name

1 If I made him the party and if retired from the services and some else has taken the charge in his place,What happens to the case if he retired from the services?

2 If I get defeated in lower court/Tribunal and makes appeal before the High Court and if he will not be on chair whether I can again made him party by name before the High Court or I will have to made party only to the designation on which he was working i.e Director, ABC organisation

When you know so much, why do you want to name the officer concerned (unless you have some personal enmity). If you want to sue, sue the organization for your remedies to avoid all the complications which you very correctly envisage.

Sir,
If the personal enmity is there as I have been terminated by his whims because before terminating me I was personally called by him and was informed that I have filed the case against the organization in the CAT SO my request for extension of services will not be considered So in that case whether making him party will be justified ?

What will be the consequences in this regard? Whether the case will be continue in his name against the organization if he removed/leave from the office
