we are having standard format of emplyoment contract. instead of taking the signature on every page we obtained employee's signature on a separate sheet attached with the said contract. whether this contract is relaible in the court of law to prove our case.

SIR, 1 TAKING SIGNATURE OF EMPLOYEE ON SEPERATE PAPER ATTACHED WITH CONTRACT MAY CREATE PROBLEMS IN COURT AND HENCE GET THE ENTIRE CONTRACT WITH THE SIGNATURE PORTION LAST PAGE ALSO PRINTED AND INCLUDED IN THE ENTIRE CONTRACT.GOOD LUCK.

When the annexure is shown in the main agreement, you can obtain the signatures and it is legaly valid.

Taking signature on separate sheet instead of contract of employment is nothing but a waste paper and hence not a valid document.you should get the signature of employee on every page of contract.

If it is treated as the part of the contract then no issue but to avoid any future complications it is better to get the signatures on every pages.

If some one gives you a cheque and his signature on another paper, will the bank en-cash the cheque???
You should obtain signatures on all the pages of the agreement/contract, only signed document page is valid in the eyes of law.

Mr Yadav, your analogy does not apply to numerous cases where only at the end the parties put their signatures.
The most important and common place example is Deed of Sale where the parties put their signature only at the end and not on all pages.
The key is whether the last page or the separate sheet is part of the same document or not.

On a general view.. Untill the employee opposing or creating any issue on this, untill that contract is valid one. At any cost the employee arise any issue mean, you only have to proof that at the time of signature in a separate paper, the employee well acquient with the contains of the contract.. If you failed mean its invalid.

In this issue i can't agree with mr.barman.. Mr.yadav giving a simple explaination to the author. Because the author is a layman.. He tried to make him clear with that little illustration. Well done mr.yadav..

Not taking signature on every page of contract and also taking taht at a separate sheet attached to the contract can easily create serious doubt on your intentions about and validity can easily be challenged and established.

Though Mr.Barman analysed the legality of such document and he is correct Mr.Dhingra caused with possible difficulties if it is challenged. Mr.Yadav's comparison of drawing a cheque with this document is not appliable here as both the instruments are governed by separate laws.
