RTI complaint

(Querist) 19 May 2011 This query is : Resolved 
can a Public authority or PIO lodge a complaint against a information seeker on the ground that he is asking a lot of information which seems to be not in the larger public interst resulting in wastage of a lot of public money and time. Incidentally the information seeker is an employee of the same public autority. If yes kindly enlight with relevant provosion / citation.

Currently in Rti there is no provison regarding this matter an so many people missusage this law i think in my sence you cant prove that some information is important or not

PIO has no such powers.

Please intimate if the PIO has lodged any complaint against the information seeker and to whom? A PIO cannot lodge such type of report.

Whether information sought irrespective of the size is exempted to be provided is to be seen by the PIO. If it is exempted he has to reply quoting the Sections of RTI Act. He can not do nothing more than this. But many PIOs opt to quote exemtptions though they are not really falls under the category of exemptions. In such if the information seeker is not satisfied, he has to make an appeal within 30 days to the Appellate Authority (within the same institution). The address of the appellate authority should be indicated in his reply given by the PIO. Second appeal lies with CIC. Seeking information is a right. Whether it will be provided or not, is the work of the PIO. Do not entertain any hesitations in seeking the required information.

THE PIO CAN MAKE COMPLAINT THAT THE QUESTIONS ARE ABUSIVE/FILTHY AND IN UNPARLIAMENTARY WORDS IN ORDER TO DEFAME, THEN THE PIO (OFFICE WHO IN CHARGE)CAN FILE A CRIMINAL COMPLAINT IT IS NOT BARRED UNDER COMMON LAW.
