asking about payment of bonous

sir..

my question is that is payment of bonus to employees having salary more than 10,000 are not eligibal for bonus as per BONOU ACT but in practical life we have seen that all emplouees even hving more rthat 10,000 rupees are also paid bonous ....then is that paymnet is out of 60% portion of availible surplus for employees or out of remaingig portion of 40% which is on discretion of employer...?

It is the discretion of employer to provide bonus to such employees and arrangement also depends upon his mercy so no question remains either from 60% or 40%.

thanx for prompt reply bt sir i m still not clear and what if employer pays then i think he can't pay out of employees porion to such empoyees who are taking salary of above 10,000.
