WE ARE STAYING IN PAGDI SYSTEM FLAT AND THE OWNER OF THE FLAT IS ON THE NAME OF MY DADS BROTHERS WIFE NAME (PREVIOUSLY WE ALL USED TO STAY TOGETHER NOW THEY HAVE MOVED TO DIFFETENT PLACE)THE PROBLEM IS THAT THE LANDORD IS NOT GIVING RENT RECIEPT NOR ACCEPTING THE SAME.I WANTED TO ASK WHAT CAN WE DO IN THIS MATTER ?AND HE IS ASKING MONEY FOR THE TRANSFER OF NAME?IF WE PAY,THEN HOW MUCH WE NEED TO PAY?HE ALSO MENTIONED WE ARE TERMED AS ILLEGAL TENANTS?IS IT SO?

if rental receipt is in name of your aunt then she is a legal tenant . if she has moved away from pagdi flat along with her family then landlord is right in saying you are illegal tenant .
what can be done is your aunt can surrender her tenancy and the landlord can admit you as tenant on payment of transfer charges . the transfer of tenancy charges are in range of 35%of value of property .

In addition to reply of Ajay, I suggest you to send your rent by way of money order or directly deposit in his bank account by way of account payee cheque and send an intimation to the landlord by way of a registered letter specifically stating therein that you had a joint family wherein you are living there on behalf of your aunt.

thnx a lot.. as in aunt is ready to surrender her tenancy but is it necessary to pay transfer charges to landlord?as of now if we want to pay rent receipt then we should pay through money order or register id?

transfer charges are levied by landlord to transfer tenacy in your name .
if you dont want rent receipt in your name then dont pay transfer charges .
since landlord is not willing to give you rent receipt ask your aunt to send rent by demand draft or banker cheque in name of landlord

Since you were staying with your aunt,keep paying rent in the name of your aunty..You are not occupying the premises illegally and your landlord cannot get you evicted from the premises.

A registered letter is different from ordinary letter,it is not put in mailbox directly,rather it is received by post office on it counter against a received issued to you for it and when acknowledgement is also attached to it you receive back the information that it was delivered to the addressee by the post office which works as proof in case of disputes,its cost perhaps is 20/= or 25/=.
