Dear All,
My bike got stolen in 2009. I got an FIR for the same. Now 2 years later police has found the bike. When i approached the police they asked me to get release papers from court. I got to know about one lawyer at that police station. This lawyer asked me 3000 Rs. to get entire thing done. I paid him 2000 in advance and now it has been more than 2months and this lawyer has done nothing. When i inquired him he told me that the police station where the bike report was made and the police station where it was found are different so he made a wrong application and wants to make a new application. Plus he's asking me more money. Apart from this he has taken my original RC book and FIR report to produce in court. I am very tensed now whether this person is charging me too much and whether he's doing anything at all. Moreover i don't know about the process so i am not sure how to get hold of him, neither i am sure whether original documents are actually needed by the court or not. Pls Pls somebody help me on this as to what i should do and whether i can trust this person. Thanks to everybody in advance. Any help or advice will be very very grateful. Regards, Saud

If he is a practising lawyer then you should believe upon him but he is charging much more and his act and conduct is highly doubtful. Generally a day or two are required for getting the release of such vehicles from the court whereas in your case, he has already taken a period of 2 months and still he has not moved another application. You should personally go to court with him and should enquire about the status of your matter and negotiate with such lawyer and should refuse to provide him any more amount.

It would be better if you take back the original documents and engage another advocate. You may for return of some of the monies but the positive result seems to be very bleak.

Engage another one as advised by Mr.Barman and make complain also at bar council as advised by Mahendra kumar.

You are NOT liable to pay for the mistake committed by the lawyer. Must approach the Bar Council to make his complaint.
But before that, ask him to give copies of documents to ensure you whether he actually made application to the court for release order of the bike or not and what was the observation of the court on that?
Also hire some reliable advocate to get your job done.

Hi Everybody, Thanks a million for all your replies. Pls tell me which document i should ask him(some specific document that is given by court when an application is made) and also is there any specific process to lodge a complain at bar council. Moreover if that person refuses to return back my documents than what should be my next step.
Thanks again.

Change of lawyer is the most appropriate step.
