if an unmarried person proposed marriage to a divorcee and a assured her that after he settle in his buisness and life he will get married to her then they started the relation based on this promise..
EVERTHING was good and he took good care of her and her child also...the women was so happy with his behavior and care that she even helped him financial and waited for him for 5 yrs to get married.
during this courtship this muslim boy even put sindoor in her maang to assure that she will be her wife..women is hindu and he even visited many temples with her...
now after 5 yrs his behavior started changing and he started ignoring her and whn questioned by d women he said tht he is upset due to some buisness loss...later on he confessed tht he got engaged to someone due to family pressure and he is sorry abt the fact tht he cant marry her..
women felt cheated and filed a complaint bt in d police station his family got scared and assured d women that his boy is on d wrong side and they will get married the boy to her...women did not filed a complain and waited for 10 days for them to decide...realtives agreed coz this women is educated and frm good family however boy refused as he was not happy with the fact tht his parents were called to d police station and all family knows about his bad deeds...
after he refused women filed a written complain and her lawyer said it is the case of Ipc 375 415 and 420...
now its been 1 month nothing happened and police has not taken any action bt just saying that they will give justice to a girl..
its a simple case of fraud cheating and breach of trust on d basis of false marriage promise..
now my question is what will be the outcome of this case ..do this case has some weightage?if yes then why d delay...
if that person get married to that girl thinking nothing is happened then who will be responsible?
women is in deep pain and regetting trusting that person.
she has lot of proofs like photograph letters and cards assuring her would be wife...
is this women can go to family court and file a case directly?
what would you suggest?

it appears that your lover has made false promise of marriage and on that basis you ahd sexual relations with him . since he betrayed your trust and refused to marry him you have filed police complaint against him .
the police are at present investigating the complaint and will record your statement of your lover . if police find that you have been cheated they may after inevstigations take action against your lover .
if no action is taken by local police wrtite to supdt of police that inspite of complaint being lodged no action is beeen taken and no investigations are being conducted .
if still no action is atken file an application under section 156(3) before magaistarte directing police to carry out investigations and submit report .

yes now d Latest update is tht d police told d lawyer tht d officer has taken d statement of the lover and he conffessed that he was involved with d women as he cant deny this considering d fact tht women has lot of proofs ,however he said tht he has done d break up with the women six mths back and maintained d friendly relation only which was a white LIE...
now d women is waiting for justice as this person has spoiled her life..now lawyer said tht Official FIR has been filed and very soon they will take action...
what would be the action and what are d chances of settlement at this stage coz women do not want to fight long case as this will be a big hassle but then she also cant let go that person so easily as he betrayed her trust and spoiled her dignity..
she still cant think tht it has happened as she was truthful in d relationship and prepared for d marriage but that person has just used her in her bad phase and still saying that nothing was fake and his love was true bt there was some family problems...
it is a very bad phase for d women as she is trapped in this relationship on d basis of trust...
That person accepted d relationship bt cooking stories abt breakup..do police believe on tht?
it shud not coz no educated and women will lie at d cost of her dignity and d proofs says all...
pls guide what wud be d outcome of all this..

your lover does not want to marry you what settlement you want ? if police find you ahve good case after inevstigations charges will be framed by court and trial will take place . you will have to attned court on avrious dates till trial is completed

yes u r right tht the chances of settlement are very less bt let me tell you the incident whn she went to the police station for the first time..and he was questioned by the officer asking do u think these letters of promises that u ve given is false..he accepted tht he made a mistake and he is sorry for tht ..he even cried saying sorry and whn this person family begged the girl that in thier family no one do this to a girl as they respect women a lot and they want some time to think about what to do...
she trusted them and his cousin supported the girl and even told the lawyer tht he broke his engagement and ready for marriage..
this guy felt so insulted in the front of his relatives that he told the girl that she has not done good by going to police station and his parents have been insulted by the elders of the family...
He is not thinking wht he has done tht the lady has gone to the police station..he promised marriage thousand times and even put sindoor in her maang and played with her emotions...
he was acting rude so she filed the case and i am helping her..
the worst thing tht is hurting the women refused her proposal of marriage telling him abt the differances bt this man spent3 mths to convince her showing his love and affection...
she still cry and say that may be he realised his mistake from heart then she will take the complain back..

FIR has been lodged one week back bt they have not called him..how much time they take to start the procedure for the fir..
Can she go to family court to file a complain directly?
is there any effect to the case if it take so much of time?
If he get married in between the procedure then will it effect him in a bad way or it do not matter to the case..?
kindly tell me if this type of case can go to the family court?

I don't think any of the sections 375 or 376, 415, 420 in this case are likely to benefit you. It is not understood, what actually you want from the said cheater by filing a police case or through the family court. You could also have known that putting sindoor in your maang has no significance for any Muslim fellow for marriage point of view.
Secondly, even if you get married with that person now after police or family court action, what do you expect to gain out of the bitter relations created by such type of case against him?
Rather, frankly speaking, finger can be raised on you also, as to why you tried to keep illicite relations with that man for 5 long years without marriage and now when he deserted you would have tried to use blackmailing tactics. SO, WHAT WILL BE YOUR DEFENCE IN THAT CASE?
Were you desirous of family relations, you could well have tried to convince him through mediators but not by use of police or family court interventions.

it seems tht if anyone ask you tht he or she has been cheated by close one by taking big amt of money and tht person waited trusting him tht he will soon return the money and he will not do that then if that person want to file a case then you (legal experts) will guide the person tht why u have trusted tht man for so long?
it is your mistake tht u ve given ur money by trusting him so u shud not file a case and forget it and now dont blackmail the person by filing a case and you cannot force anyone to fulfill the promise...
thank you to all legal experts by giving wonderful advice to all those who want to file a cheating case...and my advice to all those is tht pls do not file any case and blame urself and take the pain coz in this country legal experts want you to sit at home and bear the pain of cheating..
and since few people take advantage of such law related to women problems so even a genuine person will be considered as the same..
anyway thanx a lot for ur help...now i will take care of my friend matter alone by studying such law coz i am not inhuman tht after hearing her story i will tell her to forget and keep thinking all her life tht someone has just used her and there was no one to help her getting justice...
