Right of share

Querist : Anonymous (Querist) 04 January 2012 This query is : Resolved
Hi,
I bought a property from my personal income in my own name or in my wife name.

My brother says that since we are joint family(though we don't live together), the property bought by me is a common property.

Please note that, there is no partition happen so far between me, my brother & my father.

Does he have a right to claim share in properties bought through my income by me in my own name or in my wife name?

Thanks in advance for your answers.

If it was indeed bought by your own income then you need not share it with any of your brother or sister.
However your brother may try to litigate it by filing a partition suit which though would ultimately fail.

Your brother doesn't have any right, but he may file a suit and may get stay order, and put you in hasty litigation system,by taking advantage of lengthy legal procedures, you can file a caveat in appropiate court.

Your brother wrongly claim. He have no right on property purchase from your own income.

You brotehr cannot claim any share in the property bought by you in your or your wife's name from your own income. it is immaterial whether you are a joint family or not.

Your brother can claim share only of the money to buy the property was earned through joint effort by you and your brother from your joint family property, if he can prove so.
