Liability of builder for common facility provided

what is the liability of builder/developers of apartments who have provided the facility like swimming pool, Gym etc., the apartment is having a swimming pool which has developed faults, experts who have checked the swimming pool have stated that the faults is in construction of the pool is their any judgments by any courts to this effect.

The society or the allottees have every right to get the construction of swimming pool in proper way. if there is deficiency, the builder is liable hence file consumer complaint.

Since one have purchase flat with this facilities, so,in case of deficiency, you can ask builder to restore the same and on not complying, you have right to go consumer forum.

Builder is liable to be held for his negligence in the construction and it amount to go to consumer forum.

Builder is responsible for fulfilling his commitment. If there is any defect on his side, you can seek the cost from them through consumer forum.

The Building was constructed 5 years a go and the problem started after 3 months of completion the apartment owners association have written several times he had promised to rectify but has not done so till today

if buidling was constrcuted 5 years back then builder is liable for constrction defects if it was observed within period of 3 months of construction .
file a complain t before the consumer forum for deficiency in service
