Construction on 2nd floor

After my parents demise and mutual agreement amongst brothers and sisters, Relinquishment deed was signed and registered in my name. Where we built Ground plus two floors over it. Initially Both Ground and First floors were transferred in one of my sisters name, which she sold later any without Roof Right.

Since 3rd floor construction is now allowed in Delhi, Can I go ahead and construct the third floor without any hindrance ?

Please reply ASAP..

The contents in the deed of conveyance is the key to reply this query.

If through the said deed only the constructed portion was transferred without any right over the roof then you can still make constructions in it unless the consent of your sister is necessary pre requisite

Thanks sir for a prompt reply.. Actually both Ground and First floors were transferred in my sisters name WITHOUT ANY ROOF RIGHT and there is no mention that her consent is required before any more construction.

My question is if any of the occupiers of the ground or first floor can hinder in my construction work ?

Read deed carefully. all further action would be subject to previous deed. For it, hire local lawyer.
