hi,if any person drinking a liquor in our car on road side and police catch him with red handed then what will be the procedure follow by the police and what kind of offence was mention in fir?

Surat, Mon Aug 17 2009, 01:48 hrsNavsari MP C R Patil’s son, Jignesh (23), was caught in an inebriated state from the Majuragate area in Surat in the early hours of Saturday.
Patil had won the Navsari seat in south Gujarat this Lok Sabha elections.
Assistant Commissioner of Police (E division) S B Rawat and his team caught Jignesh and two others during a night patrol in the area.
The police found a Toyota Innova (GJ-5-CH-5096) parked on the roadside near the RTO circle, and upon inspection, found three youths consuming liquor inside.
They were arrested under provisions of the prohibition law and were taken to the police station for further investigations.
The three were identified as Jignesh Chandrakant Patil (23), a resident of Dinbandhu Society on Bhatar Road; Muzaffar Kapadia (22), a resident of Nishad society, Adajan Patia; and Ibrahim Fitter (19), a resident of Mota Varachha.
They were later taken to the New Civil Hospital for medical examination and released on bail on Saturday morning from the Umra police station.
Rawat said: “Law is the same for everybody. We were not aware that Jignesh is the son of C R Patil, but later, after all official procedures, he did disclose his identity to us.”
He added, “We also found them playing cards inside the car.”

New Delhi: That drink by the roadside is now going to cost you dear if you are in Delhi. The state government has increased the fine on drinking in public places from Rs 200 to a hefty Rs 5,000. And if a person creates nuisance after downing a few pegs, the penalty could be as high as Rs 10,000 and three months in jail. However, it's not all bad news. There is some good news for tipplers. The new liquour laws allow malls with an area of 1,000 square feet or more to serve liquour. But many Delhiites still have one grouse - the minimum permissible age for being served liqour in bars and pubs remains 25 despite the fact that the law now allows 21-year-olds to serve liquour in bars.

you have not mentioned where you are located . if in gujrat you will be booked under prhibition laws . if in delhi fined upto rs 5000. and if you are creating nusiance then fine may be upto rs 10,000
