In case of divorced parents ,if child is to be adopted by a third person, does the parent who has permanent custody needs sign of other parent too who has left access to child willingly in MOU?

parents consent is must to give child for adoption . they have to sign in writing that they have no objection for giving child for adoption

Being a biological father/mother the consent of other parent too is necessary for giving child in adoption.

MOU for child custody is not the legal document so consent of both parents is necessary.

It is better to get the sign of the Father who is the natural guardian. If he has abondoned then divorce order and custody of child is with the wife then you can get the agreement signed by the mother alone stating all these reasons.

If the father has abandoned, then a suit for declaring the sole guardian has to be preferred before mother alone can sign the said adoption deed.
