(Querist) 29 March 2012 This query is : Resolved
What are the various legal ways of serving the notice to company for vacating the residential property leased to them.Company has informed me by email that their employee who is residing there has resigned, so they will not pay his rent from next month. Can I send notice to company by email?
V R SHROFF (Expert) 29 March 2012
u send notice thru ur Advocate, that rent is payable till the date u hand over me the vacant peaceful possession of my flat.

& Vacate the Flat.
Raj Kumar Makkad (Expert) 29 March 2012
You should understand the meaning of the notice of the company that they have no liability of paying the rent of the employee residing in your leased out property on behalf of the company because he has resigned.

That notice is meant for cessation of lease agreement. Now you have to issue notice to the employee residing therein to immediately vacate or pay rent as per your desire because company is not going to pay you.

You can issue a notice in this regard to him with copy to company.

Thanks Mr.Makkad and Mr. Shroff

Can I serve the notice to both parties by email or by regd. mail or by speed post, which is legally acceptable?
Deepak Nair (Expert) 29 March 2012
It is better to serve the notice by registered post or speed post.

If you had any agreement with the company, the said notice sent by the company is notice for termination. You have to sent a reply to the company to handover the vacant possession of the premises or pay rent till they hand over the vacant possession.

Thanks Mr. Nair
