Without acknowledge bills

Dear All,
My query is this that, whether

We can file a recovery suit for outstanding payment, if the Acknowledge of bill misplaced.

We have correspondence regarding of follow up with party/customer, agreement, related bills of certified. Please help by guidance of any legislations/precedent.

yes you can file . has the debtor denieed having received the goods ? contact a local lawyer and file summary suit

You can file the suit. But you should prove the liability beyond doubt.

yes! you can if you have proof of debits on account of sale with corroborative evidence.

There is no bar in filing the suit, but remember as per evidence act each and every entry of the account book must be proven.

The correspondence with your customer and other documents such as agreement etc are sufficient to file the suit. File the suit before limitation of 3 years from the date of default.
