sir, my business partner wrongfully grabbed the pvt ltd co.and later came to compormise with help of few gentlemen and gave me a cheque for settlement of dispute.the cheque bounced,i filed a case u/s138 ni act,he was allowed by the court u/s205...etc.sir i want to know can i get any relief from heigh court u/s 438 of company act.

You can very well approach High Court seeking winding up of your company under sections 435, 436 & 436 of Company act, 1956 and High court shall decide it under section 438.

Your query is incomplete. It is not understood, whether you want solution to grabbing of your company or recovery of cheque amount?
You have not mentioned how he grabbed the company without removing you as drector of the company, and if removed you, how he could do that?
Also, you have not elaborated, he was allowed WHAT and you are referring to sec. 205 of the CrPC, IPC or Company's Act?
You have also not mentioned whether you desire relief for recovery of the cheque amount or the repossession of your company?
If you are so brief in your statement of incomplete facts even with your own lawyer, I doubt, if you can get positive results.
