Hello,
I need help in medical negligence, recently my sister went for ectopic pregnancy test, which is life threatening if it is wrong diagnosed, but the Diagnostic center radiologist didn't do her work and said nothing is there.
She didn't even check the B-HCG report to confirm it clearly shows that the levels were suggesting pregnancy but didn't gave any observation she ruled out as it is not ectopic pregnancy.
After two weeks we have to go to nearby hospital for emergency operation as the tube was punctured due to this and with God's grace she survived, she had less than 50% chances before operation.
I want to take action for their negligence, Please tell me what should I do.
The diagnostic center management also behaved careless regarding the complaint. Can I also file complaint against the diagnostic center for hiring less proficient staff.
Please tell me what can I do.
Thanks in Advance.
Regards,
Farooq.

As you have already made a complaint to the management and your grievance has not been properly addressed so file a consumer complaint.

Can you tell me whether it comes under criminal or civil law or I have to go for consumer court?

You can file a criminal case u/s 304A of IPC and you can file a case for claim of damage due to medical negligence in consumer court.
