Paid weekly off

sir,
in my institute we got labour work through contractor. we pay them remuneration for 26 working day including epf, esic and service tax. whether we have to 4 paid weekly off to contractor also. we are principal employer while the contractor is immediate employer. pl suggest me

It depends on nature of job on which contracted employee are engaged. If is last though out the week, you are liable and if it is of casual nature or intermittent, no need to pay for weekly off.

kirti sir, the labour are working in farms for 6 days a week but for whole month. now please suggest me whether we have to pay weekly off

The principal employer will have to ensure that the contractor allows a paid weekly off after every six working days or to pay overtime allowance/ wages, in lieu of weekly off, for extra day a labour spends on work in addition to the regular daily/weekly/monthly wages, as the case may be. if not the responsibility would devolve on the principal employer for violation of labour laws.

It is not relevant whether the working of form continued for whole of the month or not. It the job on which the contracted employees are engaged. if nature of job is casual nature, they are not entitled for weekly off.
